Title 40.1-51.1.(A), Code of Virginia: The employer did not furnish
employment
and a place of employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to employees in
that,
while retrieving traffic cones, employees were allowed to ride in the
bucket of
a Frontend Loader/Backhoe while traveling north bound against traffic on
the
south bound side of Route 13, 1/4 mile past the Red Apple Mini Mart in
Suffolk,
Virginia, thereby exposing employees possible injuries from falling and
being
crushed or struck by the loader or other passing vehicles.
Note: One feasible and acceptable abatement method, among others, to
correct this
hazard is to adhere to 1926.601(b)(8): Vehicles used to transport
employees shall
have seats adequate for the number of employees to be carried.
