North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)establishment, parts storage area -- employer utilized a shelving unit for storage of heavy metal parts without determining load capacity, stability and adequacy or the storage unit for its intended us. ABATEMENT:Determine load capacity, stability and adequacy and implement industry and manufacturing recommendations as necessary to assure the shelving unit is fit for the intended purpose.

North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)establishment, Parts storage area -- employer failed to provide bracing for the metal shelving unit used to store the machine gears and other supplies. The 11 foot long shelving unit was made up of a 48 inch section on the left, a 48 inch section in the middle, and a 36 inch section on the right. The only bracing used to provide front to back stability of the shelving unit was on the very left end of the shelving unit in the form of a solid end panel. No bracing was provided between each section or on the right end. The shelving unit fell over, struck an employee, and the employee was killed. Among other methods, industry recommended practices and manufacturer's recommendations for similar metal shelving include bracing on each end and at least between every other section. THIS CITATION WAS DISMISSED AS OF 09/02/97.
