North Carolina General Statute 95-129 (1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish to each of his employees conditions of employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:
a) fabrication building  --  the employer did not insure
that the work area, inwhich construction workers were
working from an aerial lift, was isolated, marked,
barricaded, or guarded to prevent moving production
equipment from striking the aerial lift.  A construction
worker was fatally injured on June 13, 1997, when an
aerial lift overturned after being struck by a bridge
crane.
NOTE: Among other methods, one feasible and
acceptable method to correct this hazard is to
mark the area where construction employees are
using an aerial lift, and not permitting the
operation of bridge cranes or other moving
equipment in the area
which is marked.nt
