North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)jobsite, truck #1444 used by employees had a tire which had less than 2/32 of an inch of tread on it. FMCSM 393.75(c): Except as provided in paragraph (b) of this section, tires shall have a tread groove pattern depth of at least 2/32 of an inch when measure in a major tread groove. Note:Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace the tire with one that meets the regulation.
