North Carolina General Statute 95-129(a)(1) of the Occupational Safety Act of North Carolina: The employer did no furnish to each of his employees conditions of employment and a place of employment which was from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)intersection of Hendersonville Road & Brickhouse Street, Fletcher, NC -- employees were observed working in the roadway without warning signs or flagman. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the procedures outlined in NC DOT Workplace Safety Manual and the Manual on Uniform Traffice Control Devices.
