North Carolina General Statute 95-129 (1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees:
a)outside under the wood storage shed--an employee was riding on and
working
from the elevated forks of a powered industrial truck while installing tin
roofing.
NOTE:Among other methods of abatement one feasible and acceptable method
is to secure a work platform, with guard rails, to the forks of the powered
industrial truck and allow the worker(s) to be secured to the truck with a
body belt and lanyard while working from the work platform.  The
operator of the truck must always be at the controls of the truck when a
worker is on the work platform.
