Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to have a foot or other extremity crushed:
Employees worked immediately in front of the moving tracks of the CMI
slip-form paver while
concrete gutter was being laid and were subject to have an extremity under
a track as it closed
with the earth.  One feasible and acceptable abatement method to correct
this hazard is to keep
the employees out from in front of the tracks while the paving machine is
moving forward.
