Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to employees employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fall hazards when:
(a)  On or about 1/13/99, an employee was riding on a Werner Fiberglass 8
foot folding
stepladder which was affixed to the back of a flat bed pickup truck by web
strapping and where
the side rails were resting on top of fiberglass pesticide storage tanks
exposing employee to
being thrown from the ladder onto the pavement from a height about 8 feet
above
the road
surface.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to establish and enforce ladder safety procedures as established in ANSI
(American National
Standard Institute) A14.5-1992, Chapter 9, Selection, Care, and Use,
Section 9.3.4 Footing
Support: Ladders shall not be placed on boxes, barrels, or other unstable
bases to obtain
additional height
