Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to employees employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm:
a.  On or about April 7, 1999, a foreman was driving a Case Model 621
front-end loader with
an employee seated in the right hand side of the bucket.  The front-end
loader was driven several
feet and the employee fell out of the bucket and was crushed at the head
under the front right
wheel.
Among other methods, one feasible and acceptable method is to:
1.  Prohibit employees from riding in the bucket of earthmoving equipment
in accordance with
the Case 621 Loader Operator's Manual, page 9.
2.  Provide additional training and information to employees in the
recognition of hazards
associated with riding on heavy equipment.
PLEASE NOTE:  CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS
REQUIRED FOR THIS VIOLATION.
