Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to employees employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that:
On or about 10/26/99, at the Olive Tree Blvd. work site an employee who
operated the
"BobCat" #746 was exposed to crushing hazards by being thrown out in front
of the machine
since the seat belt was locked behind the operators seat and not used and
the safety bar was not
engaged.  Among other methods, one feasible and acceptable method to
correct this is strict
enforcement of policy prohibiting the operation of equipment by rendering
interlocks inoperable.
Ensure that mgt. enforces safe practices for skid steer operation and
maintence of equipment.
Train employee in correct and safe operating proceedure.
