General-duty citation text

KRS 338.031 (1)(a):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or
serious physical harm to employees in that: There is an insufficient
preventative maintenance
program for treatment system cylinders # 1 and # 2 in that:
1. The employer could produce no evidence that the cylinders had
ever been pressure tested; or re-tested in accordance with
accepted engineering and industry standards.
2. The employer could produce no evidence that the cylinders had
ever been checked by competent persons for the expected
remaining life, in accordance with  accepted engineering and
industry standards.
3. The employer could produce no evidence that the systems
pressure relief valves had been re-check for proper set point and
operation on a routine schedule, in accordance with  accepted
engineering and  industry standards.
4. The main check ( 2-1/2" ) valves on the high pressure side of
the system were being used in excess of their design value; they
were 150 PSI valves and were being used at 195 PSI.
(a) for the treatment operator who normally works in the area most of the
time and would be
exposed to any spills, ruptures, or explosions if the unit(s) were to
overpressurize.
(b) for other workers in the area such as but limited to yard workers
which periodically work
in the area and would be exposed to any spills, ruptures, and explosions
if the unit(s) were to
overpressurize.
Applicable methods of compliance can be obtained by using recognized good
engineering practices such as but not limited to American Society of
Mechanical
Engineers (ASME) Boiler and Pressure Vessel Code Section VIII, Division I,
The
National Board Inspection Code (NBIC), American Petroleum Institute (API)
and
Title 815 KAR 15:020 Section 3.
