Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
the hazards associated with the obstructed view of a Kershaw Tie Handler
operator while moving
down a deactivated track on the RTA Redline Rehabilitation Project,
Cleveland, OH.  Lack of
visual integrity due to the overloading of a flatbed car being pushed by
the tie handler obscured
the operator's view of employees working directly on, and to the left, of
the track.  This
exposed employees to the possibility of a crushing and/or amputation-type
injury.  Among other
methods available to abate this hazard, one feasible and acceptable method
was to restrict the
number of ties to be stacked onto the flatbed car. Another would have been
to stack the ties on
a flatbed car being pushed instead of pulled by the tie handler ensuring
the vision of the operator
is not obstructed in the direction it is moving.on
