North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees in that employees were
exposed to:
a)the hazard of being struck by or run over by customers vehicles at the
Troutman
Quick Lube facility. Customers drove their vehicles onto the oil and lube
bay
while the employee stood in front of or in the path of the vehicle to act
as a
guide. Employees were exposed to the hazard of being struck in the event
that the
customer failed to stop, prior to and on March 2, 1998.
Among other methods, one feasible and acceptable abatement method as
referenced by the American Petroleum Institute document entitled "Service
Station
Safety" and the National Institute for Occupational Safety and Health
document
entitled "Job Health and Safety Guide for Auto Repair and Body Shops" would
be to adopt procedures that would remove employees from the path or danger
zone as the vehicle moves into the facility. The employee should be on the
driver's side, a few steps back and to the right of the bay.
