North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall from elevation. Tops of ordinary type portable fiberglass step ladder(s) were used as steps: a)office roof - for the employee standing on top step of a fiberglass ladder while accessing the office roof where materials were stored. The top step of the ladder was 6 feet above the concrete floor.
