North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)establishment, lockout/tagout procedures for values and electrical devices on refueling trucks (Ref: National Fire Code 407, chapter 3, paragraph 3-1.2) Feasible and acceptable method to correct this hazards includes would be to ensure that the development of written lockout/tagout procedures to be included in a lockout/tagout program (LOTO) for general industry as outlined in 29 CFR 1910.147.
