North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)employees exposed to hazards while working approximately 12 feet above the lower surface without installing a guardrail system, ladder, or fully planking the working level were not properly trained. or in the alterative: 29 CFR 1926.454(c): When the employer has reason to believe that employees lacked the skill or understanding the need for safe work involving the erection, use or dismantling of scaffolds, the employer did not retrain each such employee so that the requisite proficiency was regained: a)employees exposed to hazards while working approximately 12 feet above the lower surface without installing a guardrail system, ladder, or fully planking the working level were not properly trained.
