Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of falling from the bucket of the backhoe: a)Jobsite: The employee working and riding in the bucket of the Case backhoe was exposed to the hazard of falling and being struck by the moving backhoe, on or about 11-3-98. One feasible means of correcting this condition would be to restrict employees from working and riding in the bucket of the backhoe. This can be established by providing an additional training program which would review the safe operation and use of this equipment.
