Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls of over six (6) feet: a)Main Street, Fort Lee: Employees working on erecting, dismantling, and maintaining carnival rides were not provided with fall protection for use during these activities. Erecting, dismantling, and maintaining carnival rides required workers to position themselves at heights over 6 feet, on or about 5/10/99. One feasible abatement method among others would be to have employees use a personnel fall arrest system.

One feasible abatement method among others is to follow the hoist's manufacturers recommended inspection schedule.n
