North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads: The supporting structure, including trolleys, monorail or crane, if any, shall be designed to with stand the loads and forces imposed by the hoist. (Refence ANSI B30.16-1981 Section 16-1.3.2. a)feed mill, maintenance shop - the rated load of overhead (underhung) chain hoist was not plainly marked on support members; employer indicated load limits were determined by capabilities of hoist. b)processing plant, battery charging area - the rated load of overhead (underhung) chain hoist was not plainly marked on support members. One feasible and acceptable method of abatement is to have beams tested and certified by a qualified person.

North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads: Frequent inspections as defined in ANSI B30.16-2.1(b)(1) and periodic inspections as defined in ANSI B30.16-2.1.1(b)(2) were not performed in accordance with Tables 1 and 2 (Reference ANSI B30.16- 1981 Sections 16-2.1.2 and 16-2.1.3): a)feed mill, maintenance shop - one Coffing 2-ton electric chain hoist and one Dufflinks 1-ton electric chain hoist were not inspected. b)processing plant, battery charging area - one C/M 1/2-ton manual chain hoist was not inspected. One feasible and acceptable method of abatement is to appoint a person to inspect and record the conditions of the hoist throughout the facility in accordance with Tables 1 and 2 of ANSI B30.16-1981 Section 16-2.2.
