North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  condition of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:
a)Agricultural Communications Building at NCSU
project- mast-climbing work platform set at 20 ft.
high presenting following conditions:
*.- open gates serving as guardrails
*.- lack of guardrail on S.E. end of bracket
platform
*.- and inadequate guardrail setting on N.E. end
of bracket platform (guardrail was set at end
of bracket platform but an unprotected gap of
2 ft. was left on side of platform.)
Adequate abatement methods for these conditions include but are not
limited to: adequate installation of guardrails on all open sides
and ends of the working platforms or the use of a fall arrest
systems. Adequate training of employees on the hazards associated
with the use of mast-climbing work platforms and work performed on
while on it and the control methods.
Reference ANSI/SIA A92.9-1993. Part 7.10 reads:" The Mast Climbing
Work Platform shall be used in accordance with this Standard and
manufacturer's instructions. The user shall direct the operator to
the following before each elevation of the platform: .....that
guardrails and mast guards are installed and access gates or
openings are closed per manufacturer's

each of his employees  condition of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to: falls while using
masts of mast-climbing work platform as means of access.
a)Agricultural Communications Building at NCSU
project- employees accessing mast-climbing work
platform set at 20 ft using platform masts as means
of access. The masts horizontal members were not
provided with slip resistant material and measured
11 in. in length. In addition there were cross
members between the horizontal members of the
outriggers that reduced their vertical space.
Adequate abatement methods for these conditions include but are not
limited to: provision of hook on ladders or other means of access
reccommended by manufacturer.
Reference ANSI/SIA A92.9-1993. Part 4.11.5 reads:" ...Mast
Climbing Work Platform shall include access means for personnel to
use in reaching the platform when it is in the lowered position.
Access steps or rungs shall have a slip-resistant surface..."!nt
