North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a bridgeplate, used by forklifts to load bricks into a railcar, which did not have a high friction surface and did not have the sides turned up at right angles to the plate. a)railhead, a boxcar was being loaded with bricks using a Toyota 5,500 pound capacity forklift #59 and the bridgeplate, consisting of 1/2" steel plate 8' wide by 5'1" long which spanned the 32" from the dock to the car was seen to flex or bend approximately 3/4" to 1" when the empty forklift exited the car, did not have a high friction surface and did not have the sides turned up at right angles to the plane of the surface, ref ANSI B56.1- 1969. Among other methods, one feasible and acceptable abatement method to correct this hazard after performing weight testing and analysis of the bridgeplate to ascertain its capacity would be to weld vertical pieces to each side and apply a non-skid surface to the plate.e
