North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  condition of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to structural collapse of
underhung hoisting equipment:(REF ASME/ANSI B30.16, Section 16-
1.3.2, 1.2.1)
a)plant, battery charging area - one-half ton rated
underslung hoist, unknown make and model, was used to
lift a 1483 pound battery and lifting yoke from an
unrated structure.
Among other methods, one feasible and acceptable method for
correcting this hazard would be to install a greater capacity
hoist appropriate to the loads that are required to be lifted,
installed on an approved design structure.
