North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Caught in hazards. a)Facility, gin, bagger/scale - Area of caught in hazard, 17" opening between funnel end and scale frame not properly guarded. A reasonable and feasable means of abatement would have been the installation of a containerized system of bag storage which even if empty would have blocked access to this space.
