North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition(s) of employment and a place(s) of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of being struck by/ crushed by motor vehicle (dump truck): a)Site, street maintenance facility - Street ready 5 ton dump truck (Chevrolet/ diesel, vehicle # 5603/ NC Lic. Tag#27837-R), audible back-up alarm was inoperable. IN THE ALTERNATIVE 29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level.

North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition(s) of employment and place(s) of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling material loads: a)Waste water treatment plant - pendent controlled under- hung electric chain hoist(Demag/ 480 vac,3 phase/2 ton cap./ SN 791280) suspended from fixed rail was not inspected and records maintained in accordance with American Society of Mechanical Engineers, ASME B30.17.2. In addition, load capacity was not conspicuously displayed. One feasible method to correct this condition would be the implementation of inspection and record maintenance procedures and training of operators in accordance with the manufacture's guidelines and ASME document.
