North Carolina General Statue 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish to each of his employees condition of employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees were exposed to a fall to a lower
elevation:
a)Southeast Corner of Winn-Dixie site - two employees
using a Strato-Lift and Boom aerial lift were working
while standing on the top rails 10' 2" above the floor
and did not have a firm footing on the platform floor
and was not wearing any fall arrest equipment (ref.
ANSI/SIA A92.6-1990, 7-11.1).
One feasible and acceptable abatement method, among others, to
correct this hazard is to always park the scissors lift in a
position relative to the work to be performed so that the
employee can stand within the confines of the platform to perform
the work.rm
