North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the possibility of being struck by a load falling from the electric hoist. a)mobile electric powered wire rope hoist, P & H, used to lift assorted items weighing up to 75 pounds, 2000 pound capacity, hoist purchased and put into use with no load test, IAW ANSI B30.16-1981, paragraph 16-2.2.2.b.1, inspection and no periodical testing since. "One feasible and acceptable abatement method, among others, to correct this hazard is to conduct a load test and document same in a historical record on the hoist."
