North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  condition of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)struck-by and/or crushed by heavy equipment - an employee
died when an International 412 Series "B" Scraper rolled
back crushing the employee against the body of a "low
boy" transport trailer when the scraper was been loaded
onto the trailer.  The trailer was equipped with a
replacement starter switch that required employee(s) to
reach into the "point of danger" to operate a Briggs &
Stratton engine used to operate a hydraulic pump used to
raised/lower the trailer hitch.
One feasible and acceptable abatement method, among others, to
correct this hazard is to disable the replacement starter
switch and repair the original equipped remote switch
(defective) which can operate the engine out of the "point of
danger".
