NCGS 95-129(1) of the Occupational Safety and Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to crushing hazards.
Employee operating the rough terrain fork lift, with over head
guard, was not wearing the installed seat belts:
a)North End of Building "E" - employee operating A716
American Eagle Forklift equipped with overhead guard
was not wearing the installed seatbelt when driving in
accordance with ANSI B56.6-1992 para 6.2.1 (a).  (Ref.
ASME/ANSI B56.6-1992)
One feasible and acceptable abatement method, among others, to
correct this hazard is to utilize the installed seat belts any
time the equipment is in operation.
