North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed inadvertent restarting of a Delta Circular Saw: a)Plumbing Build-Up area: a Delta Circular Saw, model #34- 080, 10" motorized miter box powered by 120Vac and 15 amp and rated at 5500 RPM, when power was inadvertently removed from the saw, did not have provisions made to prevent the saw from restarting upon restoration of power. Among other means, one feasible and acceptable abatement method to correct this hazard is to contact the saw manufacturer and obtain and install a switch to prevent this from occurring.
