Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed crusing injuries due to the hazards associated with
riding on
conveyors as is addressed by ANSI B20.1 -1976 Paragraph 5.12.4 which
states Where a
hazard would exist, no person shall ride the load-carrying element of the
conveyor, except on
conveying devices which incorporate (within their supporting structure)
platforms or control
stations specically designed for the operating personnel, or where persons
riding on a slow
moving assembly conveyor or riding on/or within a product on a slow moving
assembly
conveyor are properly instructed of any hazards present:
(a)Main conveyor which has wooden slates, employees were riding on the
conveyor when they were attempting to remove different types of paper which
did not belong in various batches that were being baled, on or about
8/25/98.
Among others, feasible and reasonable abatement methods would include:
1.Comprehensive instruction of employees working around the conveyor
regarding the hazards of this type of a conveyor and instruction on how to
communicate the need for the conveyor to stop so that they could safely
remove materials from the conveyor without placing themselves in danger.
2.Using signage in the vicinity of the conveyor which warns of the hazards
of
moving conveyors.
3.Fully instructing the button-man of the hazards of employees accessing
the
conveyor.
4.Monitoring the area to insure compliance with the above measures and
incorporating disciplinary action for non-compliance.
