Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about 11/17/98, an employee was observed driving a Nissan 50 Model KAPH025A25V Type C Chassis Number KAPH02-900783 Forklift without the manufacturer restraint device installed, thereby exposing the employee to serious injury as a result of entrapment of the operator's head and/or torso between the truck and the ground in the event of a tipover. (b) On or about 11/17/98, an employee was observed driving a Nissan 50 Model KAPH025A25V Type C Chassis Number KAPH02-P900179 forklift without the manufacturer restraint device installed, thereby exposing the employee to serious injury as a result of entrapment of the operator's head and/or torso between the truck and the ground in the event of a tipover. ABATEMENT: One feasible means of abatement, among others, is to reinstall the seatbelt and enforce the usage of seat belts on all forklifts equipped with them. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
