NYSLL Article 2 Section 27a(3a)(1): The employer did not furnish to each
of its employees,
employment and a place of employment which were free from recognized
hazards that were
causing or were likely to cause death or serious physical harm to its
employees and which
will provide reasonable and adequate protection to the lives, safety or
health of its
employees. In applying this paragraph, fundamental distinctions between
private and public
sector employment have been recoginzed:
(a) Madison County Sheriff's Department- Madison County COrrectional
Facility, did not
furnish employment and a place of employment which were free from
recognized hazards
that were cuasing or likely to cause death or serious physical to
employees exposed to the
hazard of being infected with Mycobaterium tuberculosis through
unprotected contact with
inmates who were infectious or suspected to be infectious with
tuberculosis (TB) in that"
isolation rooms were not kept under negative pressure.
Reasonable and adequate methods for reducing this hazrd, as recommended by
the CDC,
include, but are not limited to:
(1) Isolation and treatment rooms in use by individuals with suspected or
confirmed
infectious TB disease shall be kept under negative pressure to induce
airflow into the rooms
from all surrounding areas.

employment and a plaec of employment which were free from recognized
hazards that were
causing or were likely to cause death or serious physical harm to its
employees and which
will provide reasonable and adequate protection to the lives, safety or
health of its
employees. In applying this paragraph, fundamental distinctions between
private and public
employment were recognized.
(a) Deputy Sheriffs of the Madison County Sheriff's Department were
exposed to the hazard
of being infected with the rabies virus through possible direct contact
with
saliva of
potentially rabid animals (such as dogs and cats) being introduced into
open cuts and wounds
in the skin or via mucous membranes.
Reasonable and adequate abatement methods for reducing this hazard, among
others are:
1) Training: A comprehensive training program include proper handling
practices, personal
protective equipment, the etiology and modes of transmission of the
disease, decontamination
and avoidance of animal/saliva contact. Training shall be provided to all
employees who are
assigned duties where there is occupational exposure to rabies.
