ORS654.010: The employer did not furnish a place of employment which was safe and healthful for employees therein, and did not furnish and use such devices and safeguards,and did not adopt and use such practices, means, methods, operations and processes as are reasonably necessary to render such employment and place of employment safe and healthful and did not do every other thing reasonably necessary to protect the life, safety, and health of the employees: (a) For this employer as a General Contractor with duties to include monitoring subcontractors work quality, performance and scheduling did not ensure safety for those employees as evidence by those employees working on scaffolding on or about 02/03/99 at approximate heights of 21 feet with multiple alleged violations of that scaffolding. OR IN THE ALTERNATIVE 29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulation applicable to his work environment to control or eliminate any hazard or other exposure to illness or injury: (a) For this employer as a General Contractor with duties to include monitoring subcontractors work quality, performance and scheduling did not ensure safety for those employees as evidence by those employees working on scaffolding on or about 02/03/99 at approximate heights of 21 feet with multiple alleged violations of that scaffolding. THIS VIOLATION WAS COMPLIED WITH AT THE TIME OF INSPECTION..
