Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

recognized hazards that
were causing or likely to cause death or serious physical harm to

a) The employer was using a drill rig to lift a 5 1/2 ton casing without
knowing the lifting
capacity of the drill rig when operated as a lifting device.
b) The drill rig was not used in accordance with manufacturer's
instructions in that the drill rig
was lifting materials which were not tools of the drill rig.
Job site:
On August 3, 1998, a CMV TH18-65 model drill rig tipped while hoisting a 5
1/2 ton casing, which exposed employees to crushing and struck by hazards.
One
feasible means of abatement, among others, would be to use a service crane
when
lifting equipment and materials not integral to the drill rig.
