Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by earth moving equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the travel path is clear and to operate in accordance with the manufacturers recommendations. Jobsite: 281 Wood Road. A Caterpillar 325B L Hydraulic Excavator was operated in the following manner: a) While in the travel mode the excavator was operated without the final drive sprockets under the rear of the machine. b) Prior to engaging in the travel mode the operator failed to rotate the cab to ensure that the path of travel was clear of all obstructions and personnel.ns
