Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, employees were
exposed to Fall and crushing hazards while entering and exiting an
excavation in the bucket of
an excavator. Among other methods, one feasible and acceptable abatement
method would be
to ensure that employees use a ladder of adequate length to access the
trench.
Location:In front of 180 Palmer Street
An employee was accessing a 9 foot 6 inch deep excavation while riding in
the
bucket of an excavator.
