Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with being struck by materials stacked on top of the guardrail of an elevated aerial work platform: jobsite: The operator of a Grove elevating aerial work platform was lifting stacks of loose plywood to the roof of the building 50 feet above the ground. The stacks of plywood could slide or blow off the guardrails of the platform and strike an an employee passing below. One feasible and acceptable method to correct the hazard would be to use a crane or proper material hoist to lift the plywood and materials to the roof.ials
