Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling merchandise due to storage rack failure.
a) Employees throughout the warehouse were exposed to the hazards
associated
with storage rack failure in that vertical uprights between the floor and
the first
horizonal beam were damaged thus compromising the stability.
b) Employees throughout the warehouse were exposed to the hazards
associated
with storage rack failure in that several of the steel "front to back
bars" designed
to support plumbing fixtures were replaced with non-rated wood pieces.
c) Employees throughout the warehouse were exposed to the hazards
associated
with storage rack failure in that non-rated plywood was being used to
support
plumbing fixtures over steel and wooden "front to back bars".
Abatement Note:  Among others, one feasible and acceptable abatement
method to correct this
hazard would be to follow the manufacturers inspection guide for repair &
replacement of the
Paltier brand pallet rack systems.
Abatement Note:  Abatement certification and documentation are required
for this item (See
enclosed "Sample Abatement-Certification Letter").
