Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of multiple injuries associated with falling fan units from the ceiling of the freezer box: a) Safeway Ice Cream Plant. The eight circulation fans located below the conveyor system were not equipped with guards/covers to prevent ice cream product from falling off the conveyor system striking the rotating fan blades. This condition exposed employees to the hazard of a falling fan unit approximately 18 feet above the working surface. One feasible and acceptable abatement method to correct this hazard is to install guards over the fan units with sufficient strength and integrity to prevent ice cream product from falling on the rotating fan blades.
