Section 5(a)(1) of the Occupational Safety and Health Act of l970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
(a)  The hazard of riding/walking on moving conveyors during operating
cycles.
Among others, one feasible and acceptable abatement method to correct this
hazard is
to instruct personnel working on or near a conveyors not to ride on the
conveyors.
5(a)(l)  Elements
(1)  The employer failed to keep the workplace free of hazards to which
employees of
the employer were exposed to a fall, strike-by and/or caught-in-between
injury when
allowed to walk/ride on moving conveyors.
(2)  The hazard is a recognized hazard in that an American National
Standard (ASME
B20.1-1996-Safety Standard For Conveyors And Related Equipment). It
states: No
Person Shall Ride on a Conveyor.
(3)  The hazard is causing or likely to cause serious physical harm if an
employee
were to fall from the moving conveyor and/or receive a strike-by and/or
caught-in-
between injury.
(4)  One feasible method to correct this hazard would be to train
personnel permitted
to operate a conveyor and to enforce at all times that walking/riding on
conveyors is
not allowed during operating cycles.
