Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: (a)Mountain View Welding at 504 Mountain View Avenue, Longmont, CO 80501: On or before 05-18-98, the employer did not ensure that the "homemade" hydraulic press, located in the Main bay, used for fabrication of metal products was properly designed, constructed, utilized, maintained and contained all appropriate safeguarding in accordance with the ANSI Standard for Hydraulic Presses B11.2. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: 1) ANSI B11.2-1995 paragraph 6.3.3 Control reliability states: "Control systems shall be designed and constructed so a single failure or fault within the system: i) Does not prevent the normal stopping action from being applied to the press, when required; ii) Does not create unintended slide motion; iii) Does prevent initiation of a successive stroke until the failure is corrected. 2) ANSI B11.2-1995 paragraph 7.1.2 Modification states: "The individual(s) modifying a press shall have the responsibility to furnish written instructions with the modifications to establish new or changed guidelines for care and maintenance of the press so modified. 3) ANSI B11.2-1995 paragraph 8.1.1 Employer responsibilities states: "The employer shall have the responsibility to provide and ensure that point-of-operation safeguarding is used, checked, maintained, and where applicable, adjusted, in accordance with this clause on every production operation performed on a press production system. 4) ANSI B11.2-1995 paragraph 8.2 Requirements for point-of-operation safeguarding states: "One or more of the following methods shall be used for safeguarding the point of operation: i) Ensure that the operator is physically prevented from entering or is removed from the point of operation as the slide(s) closes; or ii) Prevent or stop slide(s) motion should the operator be within the point of operation; or iii) In applications which preclude the use of the above and where risk analysis allows awareness devices or signals, specified work practices or a lockout/tagout procedure (see ANSI Z244.1) shall be implemented.
