North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees, in that employees were exposed to:
a)Jobsite - employee working from aerial ladder at
elevation of approximately eighteen feet without
personal fall arrest system.
Reference ANSI/SIA A92.2-1990, "Vehicle-Mounted Elevating and
Rotating Aerial Devices", Section 10.2, which states:  "During
operation of the aerial device the operator shall war a harness and
be connected the aerial device with a lanyard at the platform
position."!
A feasible means of abatement is to provide full body harness
designed for fall arrest, with lanyard and to instruct employees on
proper use and anchor method.  Additionally, use must be required
by employer.lly,
