North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees, in that employees were exposed to being caught in,
under, or between:
Hooks on overhead hoists were not equipped with latches where the
application did not make the use of the latch impractical.
a)small motor repair - hooks for the CM lodestar 2 ton
hoist and the Yale 2 ton hoist were not provided with a
latch.
One feasible and acceptable method of abatement among others, is to
equip the hooks with latches as stipulated by ANSI B30.16-1981,
Chapter 16-1, Section 16-1.2, Article 16-1.2.9.
