North Carolina General Statue 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees, in that employees were
exposed to being
crushed by the trash compactor ram because the emergency stop controls
were not readily
accessible to the operator::
a)trash compactor -- when the employee was dumping trash from 50 gallon
plastic
trash cans, the Emergency Stop controls were 7' from the operator.(Ref.
ANSI
Z245.2 1992, Sec 7.5.3)
one feasible and acceptable method, among others, to correct the hazard is
to
relocate the control panel to a point 3' from the employee while the
employee
is
dumping trash.g
