North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
piercing and impalement - The employer did not take measure to
ensure that protruding nail stakes "form pins", onto which
employees could fall against were guarded.
Among other methods, one feasible and acceptable abatement
method to correct this hazard is to cover the nail stakes with
protective caps.
