North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: crushing injuries: a)transfer point-employee was riding half inside and half outside of a Case 821B wheeled loader while attempting to operate a camcorder. (ref para 4.3 SAE J153 May 87, and page 7 Machine Operation of the Case 821B Loader Operators Manual Rac 9-23935) One possible abatement would be for the employer to ensure only trained, qualified, and authorized employees ride on equipment and all equipment manufacturers operating procedures are followed.

North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: crushing injuries: a)transfer point-an untrained employee was attempting to operate a Case 821B wheeled loader and a camcorder, in an effort to recreate a fatal accident by having the operator instruct him on it's operation.(ref para 4.1 SAE J153 May 87,) One possible abatement would be to instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment. Further, restrict operation of equipment to those that have been trained and authorized to utilize such equipment.

North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: crushing injuries: a)transfer point-employee was laying on the ground at the site of an accident to recreate the incident by having a Case 821B drive toward him while a fellow employee, riding on the vehicle, taped the procedure with a camcorder. (ref para 6.1 SAE J153 May 87, and pages 6&7 Machine Operation of the Case 821B Loader Operators Manual Rac 9-23935) One possible abatement would be to instruct each employee in the recognition and avoidance of unsafe conditions and to the regulations applicable to unsafe work areas. Further, all safety precautions outlined in the equipment manufacturers operating manual shall be adhered to.
