North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish each of his employees conditions
of employment and
a place of employment free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees in that employees were exposed to a
fall to a lower level:
a)accident site --on or about 06/19/98, an employee was welding steel
bonding
supports while elevated on a platform attached to the forks of a Lull
(Model 644
B-37) rough terrain forklift. The employee was wearing a body harness and
lanyard, but disconnected the lanyard while attempting to exit the
platform and
access the 2nd floor of the building. The forklift turned over and one
employee
fell 62' to the ground while another was still attached to and hanging
from the
suspended platform. (Ref. ASME B56.6-1992 Sec. 5.15 (u))
One feasible and acceptable abatement method, among others, to correct the
hazard is to  ensure that personnel maintain a firm footing on the
platform floor
unless secured by body belt and harness.

Carolina:  The employer did not furnish each of his employees conditions

or serious physical harm to employees in that employees were exposed to a
fall to a lower level:
a)accident site --on or about 06/19/98, two employees were doing welding on
building steel supports. The employees were in a homemade personnel basket
platform attached to a Lull Model 644 B-37 rough terrain forklift boom. The
basket was 6" horizontally from the building, and as an employee attempted
to
step out of the basket and onto the building floor, the vehicle fell over
injuring
the two employees. The basket platform was not lowered level with the floor
surface to allow the employees to safely egress the basket, and the
employee
stepped on the basket toeboard as he exited. (Ref. ASME B56.6-1992 Sec.
5.15
(w))
One feasible  and acceptable method of abatement , among others, to
correct this
hazard is to ensure the basket platform is lowered to the floor and is
supported
by a firm surface capable of supporting the platform so that employees can
exit
the basket safely.
