North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to operating ROPS-equipped tractors that did
not have safety belts installed:
a)site, 8900 block of Six Forks Road, Raleigh, NC, west
side - 1972 Ford series 5000 tractor, blue, number
C325698, model EL10146, unit 2A11B, with ROPS number 19-
933, 2 post, 62 in. height by 38 in. width, and pulling
Leinbach Line 30-T rake implement.
b)site, 8900 block of Six Forks Road, Raleigh, NC, west
side - Ford 260C tractor, yellow, with ROPS number 18-
117, and fertilizer attachment.

rollover protective structures or adequate canopy protection was
