North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were not effectively trained regarding the safe operation
and lifting limits of skid steer loaders:

a)Site & yard waste compactor area - employee trapped
inside Bobcat skid-steer loader(model 753,#6722934) that
was caught on a parapet wall, was exposed to a 16.5 ft.
fall into a compactor ram chamber.
A reasonable and feasible means of abatement would
include:
1) Retrain employees regarding equipment lifting load
limits as specified by the loader manufacturer
2) Provide employees with material load weight charts and
train employees to calculate material loads so as to
eliminate overloading
3) Monitor operator work activity to determine compliance
with safe equipment operation procedures
4) Determine if parapet wall height could be increased to
at least the height of loader wheels so as to prevent
another tip-over incident
