North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees, in that employees were exposed to:  Multiple fall
hazards associated with climbing up onto flatbed loads, working on
top of flatbed loads, and climbing down from flatbed loads:
a)Barry's Truck Lines, Inc., on tractor trailer trucks and
Trail Mobile trailers - for the Barry's Truck Lines
diesel truck drivers who, as a part of their normal
duties and training, were required to climb up to and
work upon previously loaded materials (up to 13' 6" above
ground level) to spread tarps over the shipping
materials, without fall protection or approved means of
accessing the top of the load.
A reasonable and feasible means of abatement would be to use one of
many types of ladders or portable stairs to access the tops of the
loads, and/or equip employees with harnesses, lanyards, and a fixed
anchor point while on top of the load.
